Introduction

Welcome to TaleCards! These Terms of Use ("Terms") constitute a legally binding agreement between you and Wonderring Technologies ("Company", "we", "us", or "our"), governing your access to and use of the TaleCards application, website, and related services (collectively, the "Platform").

By accessing or using TaleCards, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

Definitions

• "User" means any person who accesses and uses the Platform, including parents, guardians, and children.
• "Services" means all services provided through the Platform, including daily story delivery, content curation, and related features.
• "Content" means all stories, images, audio, text, and other materials available through the Platform.
• "Account" means your registered user account on TaleCards.
• "Subscription" means any paid plan or service offering access to premium features.

Eligibility and Account Registration

To use TaleCards, you must be at least 18 years old or have the permission of a parent or legal guardian. By creating an account, you represent and warrant that:

• All registration information you submit is accurate, current, and complete
• You will maintain the accuracy of such information
• You are legally capable of entering into binding contracts
• You will not create an account using false or misleading information

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Subscription and Payment Terms

Free Trial and Premium Subscriptions

TaleCards may offer free trial periods and various subscription plans. By subscribing to a premium plan, you agree to pay the applicable fees as described at the time of purchase.

Billing and Renewal

• Subscriptions automatically renew unless cancelled before the renewal date
• You authorize us to charge your payment method for renewal fees
• Prices are subject to change with advance notice to subscribers
• No refunds will be provided for partial subscription periods

Cancellation

You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation will be effective at the end of the current billing period.

User Conduct and Prohibited Activities

You agree to use the Platform for lawful purposes only. You agree NOT to:

• Post, transmit, or share any harmful, offensive, defamatory, or inappropriate content
• Harass, bully, or threaten other users
• Violate any intellectual property rights or proprietary rights
• Use the Platform for any commercial purposes without our express written consent
• Attempt to gain unauthorized access to our systems or networks
• Distribute spam, malware, or other unsolicited communications
• Reverse engineer, decompile, or attempt to extract source code from the Platform
• Remove, obscure, or alter any copyright, trademark, or proprietary notices
• Use automated systems (bots, scrapers) to access the Platform
• Impersonate any person or entity or misrepresent your affiliation

Content and Intellectual Property

Ownership

All Content available on TaleCards, including stories, images, audio, graphics, logos, and software, is owned or licensed by Wonderring Technologies and is protected by copyright, trademark, and other intellectual property laws.

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and Content for personal, non-commercial purposes only.

Restrictions

You may not:

• Reproduce, distribute, or publicly display Content without our permission
• Create derivative works based on our Content
• Use Content for commercial purposes or financial gain
• Remove or modify any proprietary notices from Content

User-Generated Content

If you submit feedback, ratings, or other content to TaleCards, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content for operational and promotional purposes.

Services and Content Disclaimer

We strive to provide high-quality, age-appropriate stories for children. However:

• We reserve the right to modify, suspend, or discontinue any service or feature at any time without notice
• Content availability may vary by region and subscription plan
• We do not guarantee uninterrupted or error-free service
• Parents and guardians are responsible for supervising children's use of the Platform

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using TaleCards, you consent to our data practices as described in the Privacy Policy.

Disclaimers and Limitation of Liability

Service "As Is"

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WONDERRING TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Wonderring Technologies, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Platform
• Your violation of these Terms
• Your violation of any rights of third parties
• Any content you submit or share through the Platform

Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

Upon termination:

• Your right to use the Platform will immediately cease
• We may delete your account and all associated data
• You remain liable for any outstanding fees or obligations
• Provisions that by their nature should survive termination will continue to apply

Dispute Resolution and Governing Law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising out of or related to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

Arbitration

For disputes not exceeding a certain amount (as determined by applicable law), you agree to first attempt to resolve the dispute informally by contacting our customer support team. If the dispute cannot be resolved informally, it may be submitted to binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996.

Changes to Terms

We may modify these Terms at any time by posting the updated Terms on the Platform and updating the "Last Updated" date. Material changes will be communicated to users via email or in-app notification. Your continued use of TaleCards after changes are posted constitutes acceptance of the modified Terms.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Wonderring Technologies regarding the Platform and supersede all prior agreements.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, or failures of third-party services.
